§ 82-123. Importation of solid waste generated and/or collected outside the boundaries of the county for disposal at a county solid waste disposal facility prohibited.

  • (a)

    Except as provided in subparagraphs (b) and (c) below, it is hereby declared unlawful and a violation of division 3 for any collector to dispose of solid waste in the county's solid waste disposal facility if said solid waste was generated and/or collected outside the boundaries of the county. For purposes of this section, the term "solid waste generated outside of the boundaries of Citrus County" shall mean all solid waste collected from residential, commercial and industrial customers of the collector whose waste is collected outside the boundaries of the county.

    (b)

    The board may, at its sole discretion, contract with a solid waste hauler(s) or with a county, city or other political entity by interlocal agreement to allow disposal of solid waste in the county's solid waste facility when the board finds it necessary to allow such disposal in order to increase revenues needed to efficiently operate said solid waste facility. The board shall be authorized to charge tipping fees different in amount than that charged to the general public or to solid waste haulers which regularly use the county landfill to dispose of solid waste generated within Citrus County. In no case shall the tipping fee be less than the actual cost of disposal.

    (c)

    The board may enter into contracts with solid waste haulers who collect solid waste generated both within and outside of the boundaries of the county and charge tipping fee rates lower than normally charged to the public provided said haulers contractually agree to dispose of a specified minimum tonnage of solid waste at the county landfill per month at an agreed tipping fee. Such contracts may be entered into when the board finds it necessary to increase revenues needed to efficiently operate its solid waste facility. In no case shall the tipping fee be less than the actual cost of disposal.

    (d)

    Tipping fees not established by a contract shall be established by resolution of the board adopted at a public hearing called for that purpose. Notice of the public hearing shall be given in a newspaper of general circulation in the county once each week for two weeks prior to the hearing.
