§ 82-76. Definitions.

  • The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning. When not inconsistent with the context, words used in the present tense include the future, words in the plural number include the singular numbers and words in the singular number include the plural. The word "shall" is always mandatory and not merely discretionary or directory.

    Biological waste means solid waste that causes or has the capability of causing disease or infection and includes, but is not limited to, biomedical waste, animals which died from disease and other wastes capable of transmitting pathogens to humans or animals. The term does not include human remains that are disposed of by persons licensed under F.S. Ch. 470.

    Board. The word "board" shall refer to the board of county commissioners of Citrus County, Florida.

    Bulky wastes means items whose large size or weight precludes or complicates their handling by normal collection, processing or disposal methods.

    Certification means the certificate/letter received by the collector issued by the coordinator certifying compliance with the requirements of section 82-101.

    Collector means any individual, firm, corporation or other legal entity authorized by issuance of a certificate/letter by the coordinator to provide solid waste collection services in the unincorporated area of the county. The term "solid waste hauler" is hereby defined as synonymous with "collector."

    Commercial collection service means service to all nonresidential, commercial and industrial establishments, except that mobile home parks and campgrounds that include recreational vehicle spaces shall be considered commercial.

    Commercial container means a waste container provided by the collector for use by the customer at nonresidential premises. Commercial containers shall range in capacity from two cubic yards up to 40 cubic yards and be equipped to be collected by mechanical devices allowing transfer into a waste collection truck or for temporary removal and replacement of the entire container during the collection and disposal process. Commercial containers shall be watertight and of impervious material and provided with a tight-fitting, watertight cover suitable to protect the contents from flies, insects, rats and other animals, and which shall not have any inside structures, such as reinforcing bands or reinforcing angles, that would prevent the free discharge of the contents. Commercial containers must display the name and phone number of the collection company.

    Construction and demolition debris means discarded materials generally considered to be not water-soluble and nonhazardous in nature including, but not limited to, steel, glass, brick, concrete, asphalt material, pipe, gypsum wallboard and lumber, from the construction or destruction of a structure including such debris from construction of structures at a site remote from the construction or demolition project site.

    The term includes rocks, soil, tree remains, trees and other vegetative matter which normally results from land clearing or land development operations for a construction project; clean cardboard, paper, plastic, wood and metal scraps, from a construction project; except as provided in F.S. § 403.707(12)(j), unpainted, untreated wood scraps from facilities manufacturing materials used for construction of structures or their components and unpainted, untreated wood pallets, provided the wood scraps and pallets are separated from other solid waste where generated, and the generator of such wood scraps or pallets implements reasonable practices of the generating industry to minimize the commingling of wood scraps or pallets with other solid waste; and de minimus amounts of other nonhazardous solid waste that is generated at construction or demolition projects, provided such amounts are consistent with best management practices of the construction and demolition industries. Mixing of construction and demolition debris with other types of solid waste will cause it to be classified as other than construction and demolition debris.

    Garbage receptacle (automated) means residential containers of up to 96-gallon capacity that are watertight, provided with a cover suitable to protect the contents, and configured to be collected by automated collection trucks. There is no weight limit on the container and contents; however the container may not be overfilled.

    Garbage receptacle (manual) means a container of not greater than 45-gallon capacity or less than 15-gallon capacity which shall be free from jagged or sharp edges and shall be watertight and of impervious material, equipped with two handles upon the side or bail by which it may be lifted, and provided with a tight-fitting, watertight cover suitable to protect the contents from flies, insects, rats and other animals, and which shall not have any inside structures, such as reinforcing bands or reinforcing angles, that would prevent the free discharge of the contents. The total weight, including receptacle and contents, shall not weigh more than 50 pounds when full. Such term also includes a waterproof bag of a material and construction that can be safely and securely closed. Such waterproof bag shall be of a type and size acceptable to the collector and approved by the coordinator, which may be used for garbage, exclusive of yard trash.

    Hazardous waste means a solid waste regulated by the department as a hazardous waste pursuant to 62-730 F.A.C.

    Person means any person or persons, including any individual, firm or association; any municipal or private corporation organized or existing under the laws of Florida or any other state; any county of this state, and any governmental agency of this state or the Federal Government.

    Private landfill means those privately owned and operated sites, places or facilities which have been permitted by the county and the state as construction and demolition debris landfills or Class III landfills.

    Solid waste disposal facility means any solid waste management facility, which is the final resting place for solid waste, including landfills and incineration facilities that produce ash from the process of incineration of municipal solid waste.

    Solid waste management facility means any solid waste disposal area, volume reduction plants, transfer station, materials recovery facility or other facility for the purpose of which is resource recovery, or the disposal, recycling, processing, or storage of solid waste. The term does not include recovered materials processing facilities which meet the requirements of paragraph 62-701.220(2) © F.A.C., except the portions of such facilities, if any, that is used for the management of solid waste.

    Special waste means solid wastes that can require special handling and management including, but not limited to, white goods, waste tires, used oil, lead-acid batteries, construction and demolition debris, ash residue, yard trash and biological wastes, and mercury containing devices and lamps.

    Tipping fees means the fees and service charges fixed periodically to be paid to the county for receiving and disposing of solid waste delivered to the solid waste management facility which may be imposed by the board for solid waste generated inside or outside the county.

    White goods mean inoperative and discarded refrigerators, ranges, washers, water heaters, freezers, and other similar domestic and commercial large appliances.

    Yard trash means vegetative matter resulting from landscaping maintenance or land clearing operations and includes materials such as tree and shrub trimmings, grass clippings, palm fronds, trees and tree stumps.

    Yard trash receptacle means a container of not greater than 45-gallon capacity which shall be free from jagged or sharp edges, and shall be watertight and of impervious material, equipped with two handles upon the side or bail by which it may be lifted and provided with a tightfitting, watertight cover, and which shall not have any inside structures, such as reinforced bands or reinforcing angles, that would prevent the free discharge of the contents. The total weight, including receptacle and contents, shall not weigh more than 50 pounds when full. Yard trash not within a receptacle shall be securely tied or bound, with each bundle not exceeding 50 pounds each, exclusive of Christmas trees.
